Heard learned Counsel appearing for the applicant and the learned AGP for the respondents. Perused the affidavit of Shri Dilip Ganpatrao Jagdale, Senior Inspector of Police, Security Branch, Navi Mumbai, which is affirmed on 11^th July, 2014.

Under clause 5 of the order dated 14^th June, 2013 passed by this Court in the main writ petition, this Court granted liberty to the applicant/petitioner to apply to this Court after complying with the deficiencies set out in the order of the Appellate Authority. Instead of applying to this Court, it appears that the applicant made an application to

the said Senior Inspector of Police. In our view, the Senior Inspector of Police had no authority to certify that the applicant has complied with the

deficiencies set out in the order of the Appellate Authority. However, the Senior Inspector of Police has tendered an unconditional apology. We accept the apology.

If according to the case of the applicant, it has complied with the deficiencies set out in the impugned order of the Appellate Authority, it will be open for the applicant to apply to the Licensing Authority. It will be also open for the applicant to produce the relevant documents before the Licensing Authority. If the Licensing Authority is satisfied that the applicant has complied with the deficiencies set out in the order of the Appellate Authority, the Licensing Authority shall submit a report on this aspect to this Court.
