The application is filed for bail. Both the sides are heard. This Court has perused the papers of investigation.

The crime is registered on the basis of report given by father of deceased . The deceased was given in marriage to Applicant no.1 about two years prior to the date of incident. She has left behind one daughter aged about one year. The father has made allegations that there was ill-treatment to the deceased from the applicant no.1 and his relatives as they had suspicion about her character. Applicant no.2 is father of applicant no.1. Allegations are made that on 17.12.2013, when the complainant learned about the incident, he went to the hospital and in the hospital, deceased

disclosed that she had set fire to herself as the husband and relatives were taking suspicion about her character and they were giving ill-treatment to her. In the papers of investigation there is record of dying declaration, which shows that the deceased set fire to herself as according to her there was ill-treatment to her from the husband and relatives and they were taking suspension about her character.

This Court has gone through the statement of one Abhijit, neighbour who had rushed to the house to extinguish the fire. Statements are made that only the deceased was present in the house at the relevant time.

The death took place due to burn injuries. The applicants are behind bar since 12.1.2014. In view of the material collected by the police and the fact that applicants are behind bars since 12.01.2014 and it is not certain as to when the charge sheet will be filed and as to how much time will be required for disposal of the case, this Court holds it is not desirable to keep them behind bars till disposal of the case which may be filed against them for the offence punishable under Section 306 , 34 etc. of Indian Penal Code. In the result, the application is allowed.
