Heard the learned counsel appearing on behalf of the petitioner and respondent No. 1 and learned AGP appearing for respondent No. 2. The petitioner has applied for the post of staffnurse and he was placed at Sr. No. 1 in the merit list. However, since the petitioner could not submit the character certificate, his appointment was kept in abeyance.

There was one criminal case filed against the petitioner for the offences punishable under Section under Sections 4, 25 of the Arms Act, 1959. Said case was pending for about ten years. The

petitioner, therefore, filed writ petition in this Court being Writ Petition No. 1478 of 2013 for quashing the said criminal complaint. By an order dated 26^th April 2013, this Court was pleased to allow the said writ petition and quashed the said complaint. It is an admitted position that the said post was not filled up and was kept in abeyance, since the petitioner has not tendered a character certificate. Since criminal complaint has been quashed, and character certificate is issued and submitted, the respondent shall permit the petitioner to join the services on the post of Staff-Nurse. Writ Petition is, therefore, allowed and disposed of in terms in terms of prayer clauses (b) and (c).
