3 The petitioners are the accused in Criminal Case No.RCS 908 of 2009 arising out of C.R.No.3022 of 2007, registered with Panchavati Police Station, Nashik. By an application dated 19 September 2009, the Assistant Public Prosecutor in-charge of the matter sought the consent of the Court to withdraw from the prosecution as contemplated under section 321 of the Code of Criminal Procedure. The grievance of the petitioners is that the

application is since then pending, without any decision thereon being taken.

4 The learned APP naturally concedes that such application needed to be decided expeditiously, and in any case, there is no justification for keeping the same pending since the year 2009.

5 Under the circumstances, the learned Magistrate is directed to decide the application dated 19 September 2009 made by the Assistant Public Prosecutor in-charge of the case, under the provisions of section 321 of the Code of Criminal Procedure, expeditiously, and in any case, within a period of one month from the receipt of this order by him.

6 Petition is allowed in the aforesaid terms.

7 Rule is made absolute accordingly.
