The grievance of the Petitioner is that though she fulfills the qualifications required for a trained graduate teacher, she has not been given the benefit of the trained graduate scale with effect from the date when a vacancy arose in the Fourth Respondent. The Petitioner was appointed on 10 June 1991 as an assistant teacher in the Fourth Respondent and at the time of appointment she held the S.S.C. and D. Ed. qualifications. The Petitioner was appointed in the D. Ed. scale. The services of the Petitioner were approved in the D. Ed. scale on 31 May 1994 by the Education Officer (Secondary), Zilla Parishad, Sangli. The Petitioner has since acquired the B.A. degree in 1995, an M.A. In 1998 and a B. Ed. in 2007. According to her, once she acquired the B.A. degree, she would enter category C of Schedule F to the Maharashtra Employees of Private Schools (Conditions of Service) Regulation Rules 1981 with effect from the year 2001. In the alternative, it has been submitted that in any event after the Petitioner passed the B. Ed. examination in 2007, she would be eligible as a trained graduate teacher to be included in category C of Schedule F. The Petitioner has made several representations inter alia to the Deputy Director of Education, Kolhapur Region, Kolhapur. On 19 November 2010 the Deputy Director of Education directed the Education Officer (Secondary) to enquire into the grievance of the Petitioner.
