The respondent nos. 2 & 3 have filed an affidavit-inreply and it is stated by the respondents that in the scrutiny held on 7th October, 2011 the petitioner was found to be prima facie eligible and the petitioner was communicated about the shortlisting of the organization of the petitioner by sending an e-mail . The affidavit refers to the e-mail ID on which the e-mail was sent to the petitioner on 17th of October, 2011. It is submitted on behalf of the respondents that after informing the petitioner about the shortlisting of the petitioner organization, since the petitioner did not appear for registering his bid till 25th of November, 2011, the respondent nos. 2 & 3 asked the International Fund for Agricultural Development (IFAD) whether permission could be granted to the petitioner to bid though the petitioner had not registered the bid within the stipulated time. It is submitted that the IFAD did not accept the request of the respondent nos. 2 & 3 and hence it is not possible for the respondent nos. 2 & 3 to permit the petitioner to register the bid. According to the learned Additional Government Pleader, since the petitioner was duly informed about the shortlisting of the petitioner organization by sending the e-mail to the petitioner, the petitioner cannot be heard to say that the petitioner was not aware about the time frame within which the bid was permitted.
