Learned counsel for the petitioner points out that the caste claim of the petitioner claiming himself as “Halba” Scheduled Tribe is still pending with the respondent no.1 Committee. He states that the petitioner is enjoying the benefits as he has been promoted on the basis of caste which he claims.

The Scrutiny Committee/respondent no.1 is directed to dispose of the caste claim of the petitioner as early as possible and, in any case, within a period of four months from the date of communication of this order. Meanwhile, no adverse action as regards services of the petitioner is concerned, be taken, till the decision of the Committee is pronounced. Learned counsel for the

petitioner undertakes that his client would not press of unnecessary adjournments before the Committee and will cooperate with the Committee for early decision. If it is found that the petitioner is instrumental or found to be involved in delaying tactics, it will be open for the respondents to approach this Court for vacating the interim order. The petitioner at the first stage may appear before the Committee between 11.00 and 12.00 nd p.m. on 22 February,2012 .

With the above observations, Writ Petition is disposed of.
