Heard Mr. Joaquim Godinho, learned advocate for the Petitioners and Mr.S.S. Kantak, learned Advocate General for the respondents.
By this petition the petitioners seek mandamus against the respondent no.2 to issue NOC to the respondent no.5 to release electricity supply and/or connection to the petitioners in terms of their application. Mr Kantak, learned Advocate General submitted that there is a dispute between forest department and revenue department as to whether property bearing Survey no. 63/2 (Part) in village Surla, Sanguem Taluka is a part of Bhagvan Mahavir Wild Life Sanctuary and could have been allotted to the petitioners. In terms of order dated 06/06/2006 of the State Government a committee has been constituted to decide the issue.
Mr. Kantak further states that the committee has not taken decision and final decision will be taken within a period of six months from today and the application made by the petitioners for release of
electricity shall be considered in terms of the decision taken by the said committee, within a period of two months thereafter.
The statement made on behalf of the respondent is accepted. In view of the statement made by Mr. Kantak, learned Advocate General, nothing survives in the Writ Petition. Writ Petition stands disposed off.
All the contentions of the petitioners in the Writ Petition are kept open.
