ORAL JUDGMENT :

Petitioner herein is raising exception to the order passed by the

Collector, Nanded on 6-11-1992 whereby petitioner has been directed to shift

¶16

his country liquor shop at some different place in the same locality. It is also

¶17

warned to the petitioner that if he fails to transfer the liquor shop from the existing place, steps would be taken for suspension of licence.

At the stage of admission of petition, this Court granted interim relief in

¶19

terms of prayer clause ‘D’ thereby suspending the effect and operation of

¶20

¶21

the order passed by the Collector on 6-11-1992. As a result of interim relief

¶22

granted by this Court, petitioner herein is running shop at the same place since last 20 years. At this stage, it would not be prudent to go into the aspect of correctness or otherwise of the order passed by the Collector. The

ends of justice would be met if the impugned order is quashed and set aside and at the same time, the Collector is granted liberty to take appropriate action and pass appropriate order, if occasion arises. Disposal of this petition

shall not be an impediment in the way of the Collector in taking appropriate action in the matter.

In the result, writ petition is allowed and the order passed by the Collector, Nanded on 6-11-1992 is quashed and set aside. The Collector, Nanded, is granted liberty to take appropriate steps and pass appropriate orders, if occasion arises. Rule is made absolute. In the facts and

circumstances of the case, there shall be no order as to costs.
