Heard. In pursuant of the order impugned in this Petition, the learned counsel appearing for the respective parties does not dispute that the Administrator has given charge back to the Managing Committee. The respondent’s appeal challenging the order under Section 78 of the Cooperative Societies Act is pending before Divisional Joint Registrar, Kolhapur. In such circumstances, no purpose will be served by keeping the petition pending. The learned counsel agrees that justice will be sub served by directing the Appellate Authority to dispose of the respondent’s appeal expeditiously. In the circumstances, petition is disposed of by passing the following order.

: O R D E R :

The Divisional Joint Registrar, Cooperative Societies, Kolhapur is directed to dispose of respondent Nos. 1 to 10’s appeal being Appeal No.138/2011 as expeditiously as possible and preferably within a period of six weeks from the date of receipt of this order.

The Divisional Joint Registrar, shall dispose of the said appeal independently on its own merits and without being influenced by the observations made by the learned Minister in the impugned order. The Divisional Joint Registrar shall dispose of the said appeal after hearing both the sides and passing speaking order.
