It appears on hearing the learned counsel for the petitioner that the Family Court was justified in granting a last chance to the respondent to file the written statement. It is a well settled position of law that the Courts are required to take a liberal approach while considering family disputes and in such cases, the grant of time to file written statement along with counter claim of one of the parties to the matrimonial dispute, would give no cause for interference with the orders in exercise of the writ jurisdiction. Hence, no fault can be found with the order passed by the Family Court permitting the respondent to file the written statement and the counter claim on record.

The learned counsel for the petitioner states that since the summer vacation is over, the order passed by the Family Court on 30.03.2011 on the Joint Pursis has been rendered infructuous.

Since this Court is not inclined to interfere with the order passed by the Family Court granting permission to the respondent to file the written statement and counter claim

on record and in view of the statement made by the counsel for the petitioner that the cause for filing the writ petition against the order on Joint Pursis has become infructuous, the writ petition is disposed of with no order as to costs.
