2] The petitioner has approached this court being aggrieved by the order passed by the respondent No.2 committee dated 30.1.2012, thereby cancelling the certificate issued in favour of the petitioner on the ground that the permanent place of residence of the petitioner is Barod, Taluka, Taloda, District Nandurbar. As such, the Committee at Nasik does not have jurisdiction to issue certificate.

3] We are of the considered view that the following order would meet the ends of justice :-

the respondent No.4 within a period of 1 week from today.

[ii] On such application being filed, the respondent No.4 shall decide the application within six weeks therefrom.

[iii] In the event, respondent No.4 grants certificate in favour to the petitioner, respondent No.5 committee shall consider and decide the claim of the petitioner within six weeks from the date of issuance of certificate by the respondent No.4.

[iv] It is further directed that no coercive steps be taken against the petitioner until decision of the respondent No.5 committee.

Rule made absolute in aforesaid terms, with no orders as to costs.
