Mr.Dani, appearing for Respondent Nos.2 & 3 have produced photocopy of the agreement executed between the petitioners and the said respondents. In view of the said agreement, nothing survives for consideration in the present petition. Accordingly, the petition will have to be disposed of on the basis of the above statement. The Counsel for the petitioners, however, submits that he has no instructions in the matter about the statement referred to above.

There is no reason to doubt the correctness of the statement made by Mr.Dani and moreso, when he has substantiated it by Deed of Cancellation, copy whereof has been produced alongwith agreement entered between the parties, which is taken on record and marked `X' for identification.

to the Petitioner to get this petition revived if the statement made is found to be incorrect.
