The petitioners have challenged the validity and propriety of this action of the State Government of resumption of entire land. The learned Single Judge of this Court dismissed the petition and held that the State Government was entitled to resumption of the lands not under cultivation. Being aggrieved thereby, the Letters Patent Appeal has been filed which is admitted by this Court and is pending for final hearing. In this background, we are afraid that the permission sought by the applicant in the present application, without due adjudication in respect of

the issue involved in the L.P.A., is not possible for us to consider and grant, hence, Civil Application is dismissed.
