This Writ Petition is directed against the order dated 6.10.2007 passed by the respondent whereby the petitioner was black listed. The petitioner has challenged the validity of the order on the ground that the same is violative of the principles of natural justice since reasonable opportunity of hearing was not given to the petitioner before passing

of the order. The counsel for the respondent, on instructions received from the respondent, makes a statement that the respondent shall withdraw the impugned order and seeks permission to issue a fresh show cause notice to the petitioner and undertakes to give a reasonable opportunity of hearing to the petitioner and seeks permission to pass a fresh appropriate order in accordance with law in this regard within ten weeks from today.

In the circumstances, the Writ Petition is disposed of as withdrawn with liberty as prayed for. The learned counsel for the respondent has stated that till a decision is taken, no fresh application from the petitioner shall be accepted.
