1.These are four applications for bail
by persons who have been arrested and charge-
sheeted for their alleged involvement in the
assault on one Ankush Ramchandra Khopde on
account of Gram Panchayat politics. The learned
counsel for the applicants states that the
investigation is complete and charge-sheet is
filed and the nature of the injuries sustained
by the victim Ankush do not show that there was
any murderous assault. She submits that offence
punishable under Section 307 of the IPC is not
at all made out. The learned APP, on the other
hand, points out that the victim had suffered
an incised wound over the scalp, apart from
fracture of clavicle and right patella on
account of an incised wound on the patella.
Therefore, according to the learned APP, the
injuries should be enough to show the intention
of the assailants. She also points out that in
the statement of Ankush he has specifically
stated about the complicity of all the
applicants but had attributed the injuries
sustained by him to the assault by Ganesh.

2.On being indicated that applicant
Ganesh would not be entitled to bail, the
learned counsel seeks leave to withdraw the
application insofar as it relates to Ganesh.
Bail Application No.1391 of 2012 is dismissed
as withdrawn.

3. As far as the other applicants are concerned, since even according to the statement of Ankush they had not actually assaulted him, they be released on bail in C.R. No.43 of 2012 of Bhor Police Station, District Pune on their furnishing P.R. Bond in the sum of 25,000/- each with one or more solvent sureties in the sum aggregating to 25,000/per applicant. The applications accordingly stand disposed of.
