This is an application for bail of two out of four accused who have been charge sheeted for the murder of Shivaji Gaikwad. Apart from the first informant there are four eye witnesses i.e. victim's mother Parvati and three members of Sitaram Gaikwad's family in whose house the incident took place. Parvati and those three members do not named the applicants. They state that other two miscreants i.e. Sakharam and Santosh were accompanied by unknown persons. The first informant named the applicants. But, he states that Shivaji was being assaulted by the applicants and two others with iron bars in front of Laxmimata temple whereas the other four eye witnesses state about the assault inside the house of the Sitaram. Clothes of the applicants seems to have been seized but

there is no report from the laboratory showing that they had any stains of blood of the victim. The applicants have been arrested on 26^th October, 2010. Considering the nature of evidence, applicants be released on bail in C.R.No.167 of 2010 of Rajgad Police Station, District Pune, on furnishing P.R. Bond in the sum of Rs.25,000/- (Rs. Twenty Five Thousand only) each person with one or more solvent sureties in the sum aggregating to Rs.25,000/- (Rs. Twenty Five Thousand only) each person on the condition that they shall attend the concerned police station on the 1^st Sunday of every month in between 10.00 a.m. and 1.00 p.m.

The applicants shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the Court or to any police officer and they shall not leave the country without the prior permission of the trial Court.

The application accordingly stands disposed of.
