Navnath Ratan Shinde Vs the State of Mah

The applicant is praying for his release on bail in connection with Crime No.I-76/2010 registered at Camp Police Station, Bhingar, District Ahmednagar, for offence punishable under Section 394 read with sec. 34 of the Indian Penal Code.

The complainant alleges that the present applicant, who was known to the complainant along with some other persons had, on the road obstructed the complainant and his companion Vaibhav Dadabhau Divate, extorted some gold ornaments, mobile phone and cash amount of Rs.96,000/-.

The learned Counsel for the applicant submits that the present applicant is behind the bars since last 48 days. The investigation is complete. A false complaint came to be filed, as a result of some other transaction between the parties. The co-accused are already released on bail having similar nature of allegations by the Additional Sessions Judge, Ahmednagar in Criminal Misc.Application No.611/2011 vide order dated 13.5.2012. The certified copy of the said order is placed on record which is marked as “X” for the purpose of identification.

Considering the overall facts that the investigation is almost complete and the co-accused are already released on bail, the application is allowed. The applicant be released on bail upon his furnishing P.R. bond in the sum of Rs.25,000/- and also upon furnishing surety/sureties in the like amount and on the condition that he shall not tamper with the evidence.
