That, prosecutrix, who was at the relevant period residing at village Taskheda, had lost her father while she was three years old. Thereafter, her mother had married for a second time and while prosecutrix was only 12 to 13 years old, her mother married her to a person. The prosecutrix, however, resided with him for a period of one year and thereafter, her paternal uncle P.W.2 Ramsunder mediated for her divorce. Thereafter, she resided with her paternal uncle for a period of 9 to 10 years. In the circumstances, about 8 to 9 months prior to filing of complaint on 24.2.1995, she had developed love relationship with the present appellant. At that time the appellant promised to marry with her. He had sexual relations with her for about four to five times in the village itself. Thereafter he took away the prosecutrix to Shegaon. Thereat, the appellant promised the mother and married sister of the prosecutrix that he would marry with the prosecutrix and resided at their houses for a period of two/three days each. Thereafter the couple came at Hinganakazi, Taluka Malkapur, District Buldana where the appellant started working as a Driver of a tractor and both of them resided as husband and wife. The appellant, all the while used to promise her that he would marry her in future. Thus, the couple resided together for a period of seven months and again came to the village of her uncle.
