This is going on since 2007.

3.Finality as regards the right of parties is still

pending adjudication before authorities under the Bombay
Public Trust Act.

4.Present F.I.R. came to be lodged bearing M.Crime No.
23 of 2011, under Sections 196, 197, 198, 464, 420, 468, 471,
107 of I.P.C. and under Sections 3(3) iv, v, viii & iv of
Scheduled Caste and Scheduled Tribe (Prevention of
Atrocities), Act, 1989, in the background of pendency of
disputes before competent Court/Authority.

5.Considering the fact that the case has a shade of
wrestling for power, and retaliation than intention of accused
to undermine the persons belonging to scheduled caste etc. and
of complainants’ in genuinely protecting their honour.

6.Therefore, applicants have made out a case for grant
of anticipatory bail.

¶31

7.Interim relief granted vide order passed by this
Court on 25th January, 2012, is made absolute.
