1.Heard. Contention is all necessary
parties essential in the suit for partition
are not joined. The trial Court has refused

to frame the issue for reasons recorded by
it. It has found that plaintiff is claiming
only share of deceased Rama.

2.At this stage, I am not inclined to
interfere in the matter. The petitioner/
defendant can conduct cross examination of
plaintiff and bring on record the fact that
all necessary parties have not been
impleaded.

3.With liberty in favour of the petitioner
to challenge again, if occasion arises,
petition is rejected.
