1] This petition is not yet admitted but parties have arrived at

settlement out of Court and, therefore, Ms.Sethna appearing for petitioner prays for withdrawal of this petition.

2] She states that respondent has deposited a sum of Rs.34 lakhs in

this Court and an order dated 16^th June 2010 passed by this Court on subject petition permits withdrawal of the said amount by petitioner’s

Advocate and, therefore, appropriate orders be passed directing Registry to issue a cheque in the said amount with accrued interest, if any, in the name of petitioner’s Advocate so as to facilitate the said Advocate to withdraw the sum and, thereafter, remit it to the petitioner which is based in HongKong.

3] My attention is invited to the order passed on 16^th June 2010 in this behalf.

4] Mr.Kapadia, learned Counsel appearing for respondents confirms the settlement and states that respondent has no objection to

the withdrawal of the above amount with accrued interest, if any, by the petitioner’s Advocate in terms of the order dated 16^th June 2010. Therefore, the Registry can be directed accordingly.

5] In such circumstances and the settlement having been confirmed, the company petition is allowed to be withdrawn and dismissed as such. The amount of Rs.34 lakhs deposited in this Court

be permitted to be withdrawn by the petitioner’s Advocate on production of authorisation in that behalf by the petitioner and the Registry to issue the cheque in the name of petitioner’s Advocate accordingly. All concerned to act on authenticated copy of this order.
