The learned counsel for the applicants
seeks leave to withdraw the application and
states that if the trial does not commence
within a period of three months, he may be
given liberty to approach this Court again. The
application is dismissed as withdrawn with the
liberty as prayed for should the trial not
commence within three months. The learned Judge
should see that in this case the applicants are
in jail for almost two-and-half years now and
therefore the trial should have commenced by
now, unless there are cases of under-trial
prisoners before the learned Judge who are in

jail for longer time. The learned Sessions
Judge should ensure that the case of the
applicants is taken up for hearing and the
learned trial Judge before whom the case is
pending does not touch newer cases before
disposing of the case of the applicants.
