deposited a sum of Rs.1,00,00,000/- with the Customs Department as per his statement before this Court on 22nd February, 2011. In view of this the Applicant's being in custody for the purpose of

further investigation may not be necessary. Hence in the event of the

Applicant's arrest in File No. SD/INT/APU/01/2010, he be released on bail on furnishing PR Bond in the sum of Rs. 1,00,000/- with one

or more solvent sureties in the aggregate sum of Rs.1,00,000/- on the

following conditions :-

i) The applicant shall make himself available on 2nd May, 2011 at 11.00 a.m. for interrogation by Investigating Officer and thereafter as and when required Investigating Officer.

ii) The applicant shall not, directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer.

iii)The Applicant has released his Passport from the department on the condition that whenever the Applicant wants to go abroad, he shall first seek permission from the Additional Chief Metropolitan Magistrate, 3rd Court, Esplanade, Mumbai after furnishing full details of proposals to be visited etc. and after the learned Magistrate ascertains from the investigating orders where it is absolutely necessary for the purpose of investigation.

iv) The application stands disposed of accordingly.
