Umabai Gangadhar Munde Vs the State of Maharashtra and Anr.

The petitioner is a senior citizen. She has prayed that a direction be given to dispose of her Land Acquisition Reference Application pending before the District Court/ Civil Judge, Senior Division, Solapur, as early as possible and in any case within a period of six months.

We have heard learned counsel for the petitioner and learned AGP. In our opinion, since the petitioner is a senior citizen, in the light of judgment of the Supreme Court in Mangat Ram Ranwar Vs. Union of India reported in AIR 1991, Supreme Court 1080, the request made by the petitioner deserves

to be granted. Hence, the petition is made absolute in terms of prayer clause (a) which reads thus:

“(a) This Hon’ble Court may be pleased to issue a Writ of Mandamus/Certiorari or any other appropriate Writ, direction or order directing the respondents and their subordinate Courts to decide and dispose of the LAR No.208 of 2001 of the petitioner pending before the District Court/Civil Judge Senior Division, Solapur, as early as possible and in any case within a period of six months.”

We clarify that the period of six months shall start running from the date of receipt of this order by the trial Court.

4. The petition is disposed of.

Copy of the order be sent to the District Court, Civil Judge, Senior Division, Solapur.
