Heard Mr. O.Y. Kashid, learned counsel for the petitioner and Mr. T.A. Mirza, learned APP for the respondents.

By this petition, the petitioner has sought the following reliefs :

(i) direct the respondent no.1 and respondent no.3 that is the State C.I.D. Crime to additional investigation/reinvestigate the crime vide F.I.R. No.151 of 2008 dated 5.4.2008 registered with Police Station, Civil Lines, Akola vide Annexure ‘B’ with this petition,

(ii) inalternative in the fitness of the circumstances the investigation in the said crime may kindly be directed to be carried by the Central Bureau of Investigation and the respondent no.1 may be

directed to take appropriate steps in that regard.

(iii) This Hon’ble Court may kindly be pleased to direct the respondents to produce the case diary, case papers before this Hon’ble Court from time to time till the completion of the investigation at the hands of the competent agency.

Reply filed on behalf of the respondents discloses that the State C.I.D. has already investigated into the crime No.151/2008 registered at Police Station, Civil Lines, Akola and chargesheet has been filed in the Court of Judicial Magistrate, First Class, Akola for the offences punishable under sections 364, 506, 302, 201, 34 and 120-B of the Indian Penal Code.

According to Mr. Kashid, learned counsel for the petitioner, the investigation has not been carried out properly.

We are not inclined to entertain this petition. The petition stands dismissed. Liberty to the petitioner to avail appropriate remedy as may be available in law.
