Heard Mr. I.S. Charlewar, learned counsel for the applicant/petitioner, Mr. T.A. Mirza, learned APP for respondent no.1 and Mr. Anil S. Mardikar, learned counsel for respondent no.2.

By this application, the applicant – Superintendent, Central Prison, Amravati seeks modification of order dated 2.3.2010 passed by this Court. By order dated 2.3.2010, we had only directed I.G. Prison, Pune to hold inquiry since it was brought to our notice that two different orders are passed on the same set of facts. By the said order, we did not direct I.G. Prison, Pune to pass order against the applicant.

It is the grievance of Mr. Mardikar, learned counsel for respondent no.2, that in the inquiry held by I.G. Prison, Pune, the applicant was not heard.

Having regard to the nature of the order passed, the grievance made by the applicant would not lie before this Bench. Needless to mention that the applicant is at liberty to avail appropriate remedy as may be available in law.

The application is dismissed. Cr.W.P. No.637/2009 Stand over to 2.8.2010.
