During the course of hearing, the learned Additional Government Pleader has placed on record the letter dated 14^th December, 2010 issued by the Government of India, the Ministry of Housing and Urban Poverty Alleviation, JNNURM Directorate, New Delhi, granting permission to shift the 349 dwelling units on Nazul plot no. 30/1, sheet no. 34/B, within the Municipal Area of Murtizapur. The said letter is taken on record and marked (X) for identification. The said letter is taken on record.

So far as dwelling units numbering 497 and

110 are concerned, the learned Addl. G.P. has made a statement in reply that State would be taking effective steps to effect minor modifications in development plan following procedure laid down under MRTP Act and thereafter they would be proceeding with the work of construction. In view of this statement, the petition stands disposed of in terms of this order. Needless to mention that interim stay, if any, shall automatically ceased to operate. No order as to costs.

No orders on CAO No. 1501 /2010 in PIL No. 15/2010 (Suresh Kachruji Dhurdev and others vs. Union of India and others-- Intervenor: Vinod Hanumandas Bang) is necessary in view of the disposal of the substantive petition.
