Heard Mr. Uike, learned counsel for the applicant. Respondent though served none appears on its behalf.

By this application, the applicant/petitioner seeks condonation of delay of 139 days in filing review application seeking review of the order dated 12.8.2009 by which Writ Petition No. 3362/2009 was dismissed on the ground of laches. By the said petition, the petitioner had challenged the orders dated 30.10.2004 and 18.2.2005 and the petition was filed in the year 2009 i.e. after almost four years. The petition was dismissed solely on the ground of delay and laches.

We are not inclined to condone the delay because no purpose would be served by condoning delay because on merits we do not find any ground to

entertain the review application. We do not find any error apparent on the face of the record and, therefore, the application for condonation of delay as well as the review application are dismissed.
