1.The husband and mother in-law of the victim Bhagyashali seek enlargement on bail on the ground that they had nothing to do with the victim�s death. The victim Bhagyashali had married applicant No.1 Chandrakant on her own, without informing her parents. Subsequently, she learnt that Chandrakant was already married to one Kavita. The victim was alleged to have told her father, when she met him on 1-3-2010, that is about 17 days before the incident, that the two applicants were asking her to bring a sum of Rs.80,000/- from her father in order to have the dispute with the first wife settled

and were ill-treating her because of her failure to bring this money. The victim committed suicide on 17-3-2010. A report in respect of this incident was given by the victim�s father on 20-3-2010. There is no dying declaration.

2.According to the learned counsel for the applicants, except for the bare words of the victim�s father, there is nothing to show that the victim was subjected to any ill- treatment on account of unlawful demands, provoking her to commit suicide. He submitted that the applicants� case is that the victim died while cooking food and, therefore, the culprit is the stove. In view of the fact that the father had not disclosed to any neutral person about the grievance of the victim after the victim first told him about ill-treatment, as also the fact that the report itself was lodged three days after the incident and since the investigation is over and the charge-sheet has already been filed, the applicants� presence in custody may not be necessary for a fair trial. The applicants be, therefore, released on bail on their giving P.R. Bond of Rs.50,000/- each with one or more solvent sureties in the like amount with the condition

that they shall keep themselves away from the prosecution witnesses till the trial is over. The applicants shall report at the concerned police station on the first Sunday of every month in between 10:00 a.m. to 12:00 noon till the trial is over.
