1.The learned Counsel appearing for the
Board States that the Board will withdraw the
criminal cases CC No.5206/SS of 2007, CC No.
653/SS of 2007 and CC No.248 of 2007 pending
before the Chief Metropolitan Magistrate, 38th

Court with liberty to file a fresh complaint,
if so advised.
2.The learned Counsel further states
that within a period of two weeks from today
the Petitioners will be supplied a copy of
the inspection report on the basis of which
the show cause notice dated 29th October,
2007, copy of which is at Exh.B, has been
issued and other inspection reports on the
basis of which other show cause notices have
been issued to the Petitioners.
3.The learned Counsel appearing for the
Petitioners states that within a period of
four weeks from the date of receiving the
copies of the report the Petitioners will
submit their submissions along with documents
on which the Petitioners want to rely to the
Board.

4.The learned Counsel appearing for the
Board states that after receiving the
submissions from the Petitioners along with
the documents, if the Board feels necessary
the Board may give the Petitioners an
opportunity of being heard personally.
However, if the Board feels that such
personal hearing is not necessary, the Board
shall proceed to pass a speaking order in
relation to the show cause notice.
Statements are accepted.
5.It is clarified that the Board shall
be at liberty to file a criminal complaint
depending on its decision pursuant to the
show cause notice. It is also clarified that
all the remedies that the Petitioners may
have against the order to be passed by the
Board are kept open to be pursued by the

Petitioners, in case the order goes against
them.
6.Petition disposed of.
