The learned counsel for the petitioner has come to this Court
with a grievance that no action has been taken in C.R. No. 46 of 2009 registered with the Worli Police Station, Mumbai and for a direction that the investigation be transferred to other competent agency. The learned APP., has

tendered the affidavit of Shri Uttam K. Mane, Sub-Inspector of Police and IO in the case attached to Worli Police Station. In the affidavit it is stated that B“ ”
Summary report has been filed on 2.12.2009 in the Court of Metropolitan Magistrate, 29th Court, Dadar. In the circumstances, the petitioner may appear before the learned Metropolitan Magistrate and file his objections to the B“ ” Summary report. On such objections being filed, the learned Magistrate shall hear and decide the same in accordance with law. The petition stands disposed of accordingly.
