The learned Counsel for the petitioner seeks leave to withdraw the writ petition with liberty to file fresh petition in view of the subsequent development i.e. issuance of amusement licence and in view of the fact that in Writ Petition (Lodg.) No. 1126 of 2009 the Division Bench of this Court, presided over by the Honourable the Chief Justice, by order dated 1st July, 2009 directed the Licensing Authority to decide the number of artists and accordingly the Licensing Authority has decided the uniform policy and all the establishments

having Premises Licence for Orchestra / Gazal for public performance have been communicated in this regard. In so far as the said communication is concerned, as stated in the affidavit in reply filed by the Inspector of Police, Pantnagar Police Station, Mumbai, the learned Counsel for the petitioner submits that the petitioner has received such communication, which they propose to challenge.
