We have heard the learned counsel for the petitioner. It appears that he had already filed a complaint before the learned Metropolitan Magistrate at Borivali and the said complaint was dismissed after recording statements under Section 202 of Cr.P.C. The petitioner has the remedy of challenging the said order before the Sessions Court in appropriate proceedings. Hence the learned counsel seeks leave to withdraw the petition. Leave granted and the petition is disposed as withdrawn with liberty as is available in law.
