On 30th June 2009 when the suit was listed before the Court, the attention of the Court was drawn to the fact that Shri H.V.Gala, the Advocate who entered appearance on behalf of the Plaintiffs has died. The Registry was directed to issue a notice to the Plaintiffs calling upon them to make such alternative arrangements as they desire in the event that they wish to pursue the proceedings. There is an office report dated 29th July 2009 to the effect that the notice has duly been served upon the Plaintiffs.

The Plaintiffs have chosen to remain absent before the
Court. Evidently, the Plaintiffs are not interested in pursuing the
proceedings. In these circumstances, the suit is dismissed for want of prosecution.
