 . This Notice of Motion has been taken out by the
 petitioner which is conducting R.A. Podar College of
 Commerce and Economics which is affiliated to
 respondent no. 1 to facilitate the appointment of
 Principal which post is lying vacant. It is submitted

 that this is pursuant to the directions issued by the
 High court of Bombay at Nagpur in Writ Petition No.
 2216 of 2006 which has been disposed of on 3.12.2008.
 The anxiety of the petitioner is that unless the
 University sends a nominee to constitute the Selection
 Committee it will not be in a position to do so within
 the stipulated period.

 2. In the given facts and circumstances, we find
 that the notice of motion can be disposed of in terms
 of prayer clause (b). The notice of motion is made
 absolute in terms of prayer clause (b).

 3. Authenticated copy of this order be furnished

 to the learned counsel for the parties to enable them
 to act upon it.
