Heard the learned Advocate for the Applicant who is the original complainant on the present application of condonation of delay of 26 days. Said delay has occurred in filing the leave to appeal. Such delay is due to the monitory constrains of the Applicant who is pensioner and senior citizen and could not approach his Advocate with arrangements of funds. Applicant wants leave of the

Court to file an appeal against the Judgment of acquittal passed on 11th September, 2008, acquitting Respondent Nos. 1 and 2 for the offences punishable under section 504 and 506 of Indian Penal Code. Reportedly, Respondent Nos. 1 and 2 are served however, none present for them.
