Apprehending arrest in CR No.152/06 which came to be registered pursuant to an order passed under section 156(3) of Criminal Procedure Code directing investigation for the offence punishable under sections 403, 406, 408,420, 418, 468, 471 and 120B read with section 34 of IPC registered with Panchvati police station, Nashik the present application has been filed. Consequent upon conducting of audit of Shriram Cooperative Bank Ltd., Nashik it was reported that some of the directors, staff members and borrowers are responsible for the disbursement of loans to undeserving borrowers thereby putting the bank to huge losses. The present applicant is the borrower. He has availed of loan in the sum of Rs.15 lacs. The applicant could not repay the amount as agreed because of financial constraints. However by now the applicant claims to have repaid the entire amount together with interest to the bank. Learned APP places on record a communication addressed by the Chief Executive Officer of the Bank to the Superintendent of Police dated 25.8.09. Perusal of the said communication reveals that after the offence was registered the applicant has repaid the amount and loan account has been closed. The details of payment are set out
