In an incident dated 1st April, 2009, giving rise to offence vide C.R. No.71 of 2009 of Police Station, Georai, the accused Shaikh Ismail is in custody dated 10th May, 2009. His brother, co-accused Shaikh Kalu, is released by the learned Additional Sessions Judge by order dated 21st May, 2009. The offending weapon is taken charge. Nothing is to be recovered from the accused. The victim Santosh and Ashok, from the police papers appears, suffered the injuries by user of hard and blunt weapon, one of the injury being incised, was probably due to sharp weapon. They are found by the medical officer to be simple in characteristics. It is informed, and not disputed, the victim and his brother were discharged from the hospital on the same date. The accused/ applicant hails from the same place; he has no antecedents of any overt act. Hence, the order.
