1The applicant who is original accused no.1

convicted under Section 307 of Indian Penal Code has
filed this bail application pending hearing of the
appeal.

2The learned counsel Mr.N.R.Dhanawade for the
applicant submits that another accused, who has been
assigned similar role of having assaulted the injured
persons with an iron bar, has been released on bail
and pleads parity with him.

2I have perused the Order by which bail has been
granted to the original accused no.8. It has been
noted that in the said Order that except for P.W.2,
none has assigned role to accused no.8. That is not
the case as regards the present applicant. Witnesses

P.W.1, P.W.6, P.W.7 and P.W.8, out of which three are
injured persons, have attributed specific role to the
applicant that he has assaulted them with an iron bar.
In the instance, I am not inclined to grant the bail.
Application stands rejected.
