The present application has been moved by the applicant with a prayer that he be allowed to go abroad to Turkey, London, New York and South Africa between 5.2.2009 to 30.4.2009 as per itinerary mentioned in the petition for the purpose of film shooting and location hunting etc. The learned counsel appearing for the applicant relies upon different orders previously passed in this case by different Division Benches of this court wherein he was granted such permission. The orders show that right from 4^th October, 2002 till

today different Benches granted liberty to the applicant to go abroad. From the record, it is clear that the applicant has not abused the liberty granted to him. However, the learned counsel appearing for

the State submits that the matter is on Board for final hearing and even if the accused is to be permitted, stringent conditions should further be imposed to ensure his presence in the event the order is adverse.

In the circumstances, we permit the applicant to go abroad to the countries mentioned in the application strictly for the purposes of film shooting and location hunting etc. It will be subject to the conditions which have been imposed by the court in its order dated 4^th October, 2002 and in all the earlier orders vide which he was granted leave to go abroad for the limited period.

In addition to these conditions, we further direct that

(i)the applicant shall be permitted to go abroad only on his furnishing two sureties in the sum of Rs.10 lakhs each to the satisfaction of the Registrar, Sessions Court, Bombay;

(ii) the applicant shall further file an undertaking that he would be present on the date when the appeal is to be heard finally.

(iii) the applicant shall report to the Indian Embassy / High Commission of India in the countries which he visits and tender his address during the stay in that country.

We make it clear that without compliance of these conditions, the applicant will not leave India and shall be strictly controlled and governed by the terms and conditions stated in the earlier orders as well as this order once he leaves India.

Application is, accordingly, disposed of.
