The order impugned in this Appeal was passed as back as on 10th July, 2008. In other words, there is no ad-interim relief in favour of the Plaintiff since the institution of the Suit. It is not in dispute that the Notice of Motion is still pending and perhaps must have matured for final hearing. If it is so, the appropriate course is to direct the City Civil Court where the Suit and Notice of Motion is still pending, to expeditiously dispose of the Notion of Motion not later than 16th October, 2009.
Appeal is disposed of on the above terms.
