 1. Learned counsel appearing for the

 petitioners submit that in view of the judgment of

 the Division Bench of this Court in Appellate Side
 Writ Petition No.6846 of 2005 (Shri Mahesh N.
 Kothari & Others V/s. The Life Insurance
 Corporation of India & Anr.) dated 5th October, 2006
 and objection taken by the respondents to that
 effect, he does not press this writ petition and
 wishes to withdraw the petition with liberty to file
 an application in accordance with the observations
 made in that judgment. He further states that the

 period of limitation may be properly considered
 keeping in view that the writ petition was filed
 under the bona fide impression. Prays for exclusion

 of time under Section 14 of the Limitation Act.

 2. In view of the statement made, the petition
 is disposed of with liberty as prayed. The question
 of limitation will be considered by the Appropriate
 Bench.
