In this writ petition, primarily, the issue raised by the petitioner and urged before us today that he had made several requests from time to time to the respondents about the grant of pensionary benefits on the basis of the amendments made in the
Army instructions and after waiting for some time, issued a legal notice dated 12th April, 2003. The said notice has not been replied by
the respondents. The petitioner claims to be relying upon the instructions including the circular dated 7th December, 1999 issued by
the Government of India.
