1. Heard Counsel for the applicant.

2. The applicant is convicted for the offence under
Section 468 of the IPC and sentenced to suffer RI for 7
years. He is convicted for the offence under Section
17-B(a), (d) and (e) read with Section 27 of the Drugs
and Cosmetics Act and under Section 18(i)(c) read with
Section 27 of the same Act. The trial Court has held
that the prosecution has established that the applicant
was transporting spurious drugs. PW 18 Satyanarayan
Kurma, Manager of Medibios Laboratories Pvt.Ltd.has
submitted that on taking physical inspection, he found
that the drug was spurious/duplicate and the packing
material and label were spurious/duplicate. This fact
has been further confirmed by chemical analysis vide
