 . Heard learned counsel for the parties and
 learned A.P.P. for the State.

 2. Mr.Kund, learned counsel for the petitioner

 states that he has instructions not to press the
 prayer for transfer of investigation to the C.B.I.
 His statement is recorded and accepted. The learned
 counsel for the petitioner further states that he has
 instructions to withdraw the petition and liberty may
 be granted to the petitioner to approach the
 concerned Magistrate for appropriate reliefs by
 making appropriate application. The petition is
 allowed to be withdrawn with liberty as prayed. If

 such application is made the learned Magistrate shall
 pass orders thereon in accordance with law. All
 contentions raised in the petition, except the
 contention regarding transfer of investigation to the
 C.B.I. are kept open. We make it clear that we have
 not expressed any opinion on the merits of the case.
 Criminal application no.4395 of 2006 be de-tagged and
 may be placed before the appropriate court. The
 petition is disposed of as withdrawn.
