1.The nomination was rejected on the ground
that the Petitioner had not established that he had
migrated prior to 21.11.1961. Prima-facie, it is
difficult to fault the Returning Officer’s decision in
view of the fact that the Petitioner’s caste
certificate was in turn issued on the basis of his
father’s caste certificate. The Petitioner’s father’s
caste certificate was issued not by the State of
Maharashtra but by the State of Uttar Pradesh.
2.In the circumstances, the Writ Petition is
dismissed. The Petition was restricted only to the
above point. The Petition was therefore entertained
by me.
