Heard Shri Naphade, learned Counsel for the petitioner, Shri Sonak, learned Assistant Government Pleader for the respondent no.1, and Shri Mishra, learned Counsel for the respondent nos. 2 and 3.
It is brought to the notice of this Court that on the earlier occasion, petitioner had filed a petition bearing No. 3130/2006 for the same grievance, which is made in the present petition and the said petition was permitted to be withdrawn by this Court vide order dated 5.7.2006. Merely because the issues raised in the said petition were kept open,

that does not entitle the petitioner to file a fresh petition on the same cause of action. It could only enable the petitioner to approach the appropriate Authorities, if any, available in law other than this Court for redressal of his grievance. In that view of the matter, present petition is not maintainable and, therefore, same is dismissed as not maintainable.
