Heard Mr. Choube, the learned counsel for
the petitioner, Mr. Thakkar, the learned counsel for the respondent no.1 and Mr. Thakre, the learned Assistant Government Pleader for the respondent nos. 2 and 3.
The counsel for the petitioner seeks permission to withdraw the present writ petition with liberty to approach the State Government against order dated 22.01.2007 passed by the Commissioner and prayed that if the proceedings are initiated before the State Government, the State Government may be asked to decide the same on its own merits at the earliest.

if the revision is filed against the impugned order and if the State Government is competent in law to consider the same, we expect the State Government to take decision on its own merits according to law and procedure applicable, at the earliest.
