During the course of the hearing the learned counsel for the parties submitted that this appeal can be disposed of upon the following consent terms agreed upon the instructions given by the parties present in court:
a) The appellant shall pay Rs 85,000/- to the respondent towards the entire claim of the respondent, and the same shall stand fully and finally settled. Thereafter the parties will have no claim or counter claim against each other.
b) The amount of Rs.1.05 lac deposited before the controlling authority with accrued interest shall be disbursed to the parties in terms of this order i.e. Rs.85,000 to the

respondent and the remaining amount shall be refunded to the appellant.
The above terms are otherwise just, fair and equitable. The appeal is disposed in the above consent terms. No order as
t costs.
